These conditions are agreed between Bramp – Metais e Polímeros de Braga Lda  (hereinafter referred to as “BRIEL”) and any person wishing to make a purchase through this site, hereinafter referred to as the “USER”.

These conditions apply only to natural persons and not to traders.

By using this site or making a purchase through it, the parties agree that their relationship will be governed exclusively by the general conditions and policies announced herein. BY USING THIS SITE, THE USER ACCEPTS THESE TERMS AND CONDITIONS. IF YOU DO NOT ACCEPT THEM, YOU MUST NOT USE THIS SITE. We therefore advise the USER to consult this document carefully BEFORE using the site to buy.

We may also change these Terms and Conditions from time to time. Whenever you intend to use our site, you should check these Terms and Conditions to ensure that you understand the terms applicable at that time. We also advise you to consult the Privacy Policy.

These conditions apply for the entire duration of the services offered by BRIEL.

ARTICLE 1 – OBJECT

The purpose of these terms and conditions is to define the general terms and conditions of sale established between BRIEL and the USER, from the moment an order is placed to the various services provided by BRIEL, such as payment methods and the terms and conditions for delivery of goods and exchange or return of products purchased.

ARTICLE 2 – PRODUCTS

The items offered for sale are presented and described with the utmost accuracy. If, despite our precautions, any errors occur on the site, BRIEL cannot be held responsible for this.

Please note that, in some cases, the colors of the products shown on this site and the color of the products delivered may differ slightly – this is due to the fact that the color balance differs from screen to screen.

All products benefit from a contractual guarantee, without prejudice to the legal guarantee (14 days). The legal guarantee also applies to non-conformities resulting from the packaging. In the event of receiving a defective product or an open or damaged package, the USER must report the fact, stating their order number and the description of the defect by email to info@briel.pt or by post to the above address. BRIEL will take steps to resolve the matter as soon as reasonably possible, in direct contact and with the agreement of the USER.

ARTICLE 3 – SHOPPING

The minimum purchase price on this site is €20 (twenty euros), including VAT.

In order to make a purchase on this site, and if you are a new USER, you must register (see Article 7 below). By making the purchase, which is understood at the time of payment, the USER unequivocally declares their full acceptance of these Terms and Conditions, and of all the information provided regarding the price, reference, weight and description of the product(s) they have chosen to purchase and which appear on their order form.

In order to register on this site, you must provide your personal details, such as name, address, email address, among others, which will be requested on the order form, and you must fill in all the mandatory fields. The USER agrees that the content they provide when registering on this site is not misleading and is true, accurate and complete in all respects and that they will inform BRIEL, or update their data, in their private reserved area, whenever there is a need to update it.

It is agreed between the parties that any dispute on these points will be resolved on the basis of a direct exchange of information and with all the guarantees mentioned in this document. In the event of unavailability of delivery of an ordered product, BRIEL undertakes to immediately inform the USER by email or telephone and to reimburse him/her for any amounts paid within a maximum period of 30 (thirty) days from the date of knowledge of the unavailability.

ARTICLE 4 – PRICES

Prices are in euros (€), including taxes and duties. The prices shown take into account the VAT applicable on the day of the order. Any change in the type of VAT applicable will always be reflected in the product prices.

The prices and specifications of the products are subject to change without prior notice. In the processing of your order, any pricing errors that may be displayed on the website due to technical anomalies will be detected. In this situation, the USER will be contacted. If the actual price of the product on the website is lower, the difference will be refunded. If the price is higher, the USER will be contacted and can choose to accept or cancel the order.

ARTICLE 5 – PAYMENT

Payment can be made through various available methods (Multibanco, MBway, PayShop, PayPal, credit card, and bank transfer) on this website at the end of the checkout process.

Upon completing the payment process and clicking the “Place Order” button, you are making a binding offer to enter into a purchase contract. However, all orders submitted by the buyer are subject to our acceptance and at our sole discretion. We reserve the right to refuse your order at our sole discretion, for any reason, without liability and in accordance with applicable law. Examples of situations in which we may not accept your order include, but are not limited to:

a) Unavailability of the products presented on the website and/or with incorrect pricing or description.
d) If we are unable to obtain authorization or validation for your payment.
f) If there is reason to believe that you have violated these Terms and Conditions.
h) If we have reason to believe that you are not a consumer but a commercial buyer.

If we cannot accept your order, we will inform you of this and will not charge you for the product.

The final validation of the order, in accordance with legal provisions, constitutes evidence and allows the enforceability of the amounts listed on the order receipt. The validation has the validity of a signature and acceptance of all transactions carried out on the website.

In any payment method, the USER has 24 hours to complete the payment. After this period, the shopping cart will be emptied, and your order will be void. Please note that we will only dispatch your order after the successful receipt of your payment.

ARTICLE 6 – SHIPPING COSTS

The shipment of orders is available for Continental Portugal, Islands, and several countries worldwide.

The ordering system automatically calculates the shipping cost.

International services are not exempt from complying with the customs regulations established for the clearance and entry of goods into the destination countries.

All shipments destined for non-EU countries will go through customs, which may affect their transit. The clearance costs must be paid by the USER, and it is possible that some type of document may be required. If any payment is necessary, BRIEL will inform the USER.

ARTICLE 7 – ORDER ACCEPTANCE AND DELIVERY

All orders, unless there is an exceptional event or stock shortage, will be shipped within 5 business days. The delivery time varies depending on the destination.

The delivery of the purchased products can be made to the address provided by the USER by simply indicating the address in the corresponding fields of the online order form.

The delivery will be carried out by the carrier. If you are not present at the specified address, a notice will be left informing you of the delivery attempt. The courier will contact you to schedule a new delivery of the order.

IMPORTANT: Delivery will not be made to PO boxes under any circumstances.

ARTICLE 8 – RETURNS AND EXCHANGES

In accordance with the current legislation in the European Union, all items can be exchanged or returned except those specifically excluded. In the unlikely event that you have any complaints about any products purchased on this website, the USER has a period of 14 (fourteen) days from the date of receiving the order to exchange or return the ordered items.

If there is a lack of conformity, the USER may return the items and choose between replacement or contract resolution, in accordance with applicable legal terms.

NEVER return the item without making prior contact with BRIEL. Our team will inform you of the correct procedure and steps to take. In all cases of exchange or return requests, the USER must contact our Customer Support Service using the above address; or via email at info@briel.pt; or by calling +351 253 303 404, from Monday to Friday, 10:00 AM to 5:00 PM.

You can return or exchange the item as long as it is in the same condition as it was sold, with the original labels and packaging and accompanied by all its accessories.

The USER has two ways of exchanging or returning the item:
1) directly at the Briel counter, Industrial Park of Sobreposta, Alagoa Street, São Mamede Este, 4715-533 Braga, Portugal,
or
2) via a carrier, which can be contracted directly by the USER, or the USER can use the contract that BRIEL has with its own carrier.

The USER must properly pack the item(s) and bear the shipping costs (if it is through our carrier, this cost will be communicated at the time of the return).

The usual procedure for the USER to make an exchange or return is as follows:
a) The USER must contact our Customer Support team, explaining the intention and providing details of what they want to do (exchange or return).
b) The USER must send a clear photo or video of the damaged or defective product and the shipping packaging.

Before we can consider issuing authorization for you to send the product, our team will analyze. Use good lighting and a close distance so that we can identify and verify the issues. Send the photograph to info@briel.

In the case of an exchange, if the new order has a higher cost, the USER will have to cover the difference, either by including the payment for the remainder with the exchange request or making the payment upon picking up the new order.

In the case of a refund request for an item purchased at a reduced price due to a special offer, Briel will refund the amount actually paid by the User and not the full price at the time of the return.

In the case of a return, the refund of the purchase amount will be made after the validation of compliance with the return conditions described earlier, and BRIEL has a period of up to 15 days for this purpose from the moment the item(s) is received in the warehouse.

ARTIGO 9 – UNDERAGE CHILDREN

The use of our website by a minor (under 18 years of age) is strictly subject to the consent of their parents or legal guardians. We strongly advise parents who allow their children to use this website to discuss with them all aspects of online safety and potential associated risks.

ARTICLE 10 – CONSEQUENCES

If we suspect, become aware of, or have reason to believe that the user has violated any of the provisions set forth in these Terms and Conditions, we may (without prejudice to our other rights and remedies) immediately take such actions as we deem appropriate, including:
a) Immediately suspend, temporarily, or permanently the USER’s right to use this website.
b) Immediately, temporarily, or permanently delete any posts or material uploaded by the USER on our website.
c) Issue a warning to the USER.
d) Disclose information to law enforcement authorities to the extent reasonably necessary.

ARTICLE 11 – LIABILITY

BRIEL has only an obligation of means regarding the stages of accessing the website, the ordering process, delivery of products, and subsequent services, excluding any liability for possible inconveniences or damages inherent to the misuse of the Internet, particularly service interruptions, external intrusions by hackers, or malicious computer viruses.

Except for any warranty cases, any transaction between BRIEL and the USER, when not contested within a period of 90 (ninety) days from its completion, cannot be the subject of any complaint.

ARTICLE 12 – INTELLECTUAL PROPERTY

All data and content on this website are the property of BRIEL and are protected under general law and national and international Intellectual Property protection legislation. The total or partial reproduction of the contents, identity, or ideas for commercial purposes, or their distribution or incorporation into any other physical or online location, in any format, is strictly prohibited. Furthermore, none of these articles, or any others, should be reproduced without prior authorization from BRIEL.

The USER who owns a personal website and wishes to place a simple direct link to www.briel.pt for personal use on their site must obtain prior authorization from BRIEL. In this case, it will not constitute an implicit affiliation or partnership agreement.

On the other hand, any hypertext link directed to the site www.briel.pt and using the framing or in-line linking technique is expressly prohibited.
In all cases, any link, even if tacitly authorized, must be removed upon a simple request via email made by BRIEL.

ARTICLE 13 – FULL AGREEMENT

These “Terms and Conditions” constitute the entire agreement between the parties in question.

If any clause of these conditions becomes null and void due to a legislative or regulatory change or by judgment, this shall in no way affect its validity and compliance.

ARTICLE 14 – EVIDENCE

The computerized records stored in the computer systems of BRIEL under secure conditions are considered as evidence of communications, orders, and payments produced between the parties.

ARTICLE 15 – KEEPING AND ARCHIVING TRANSACTIONS

The archiving of orders and invoices will be carried out on a reliable and durable medium to correspond to a faithful and lasting copy.

ARTICLE 16 – APPLICABLE LAW AND JURISDICTION

These Terms and Conditions and other policies published on this website are governed by Portuguese law. Any legal issues arising from these Terms and Conditions will be settled by the court of Braga, Portugal, with express waiver of any other jurisdiction.

Alternatively, in the event of a consumer dispute, the consumer can use the European Online Dispute Resolution Platform or the following alternative dispute resolution entities for consumer disputes.
